Terms of Service
Effective date: August 21, 2026
These Terms of Service govern access to and use of HumbleHours, including its website, web application, Android application, kiosk mode, APIs, reports, and related services. By creating an account or using the service, you agree to these Terms.
1. Acceptance and authority
You must be at least 18 years old and legally able to enter into these Terms. If you use HumbleHours for a company or other organization, you represent that you have authority to accept these Terms for that organization. In that case, “you” includes the organization and its authorized users.
If you do not agree to these Terms, do not access or use HumbleHours.
2. The HumbleHours service
HumbleHours provides tools for workforce timekeeping and operations, which may include:
- employee clock-in, clock-out, break, note, and time-adjustment workflows;
- work schedules, locations, positions, paid-time-off designations, and attendance views;
- optional GPS-based worksite verification and paired kiosk access;
- administrative roles, permissions, notifications, and audit records;
- timesheets and scheduled or on-demand reports in supported formats; and
- mobile features such as device-based biometric sign-in where supported.
Features may depend on your configuration, device capabilities, permissions, location services, email delivery, or other technical requirements.
3. Accounts and access
You are responsible for accurate account information and for safeguarding passwords, kiosk PINs, pairing codes, devices, and other credentials. Each person should use their own authorized account unless a feature is specifically designed for shared use, such as an authorized kiosk.
Workspace administrators control user access and permissions within their organization. You must promptly revoke access for people who are no longer authorized and notify HumbleHours if you reasonably suspect unauthorized access or credential compromise.
4. Customer and employer responsibilities
HumbleHours supplies software tools; you remain responsible for how your organization configures and uses them. You are responsible for:
- complying with wage-and-hour, payroll, employment, privacy, labor, recordkeeping, and workplace-monitoring laws that apply to you;
- providing employees and other users with all required notices and obtaining any required consent, particularly for location collection, device identifiers, notifications, and kiosk use;
- setting appropriate pay periods, workweek rules, overtime options, break rules, schedules, time zones, worksite radiuses, and permissions;
- reviewing time entries, calculations, edits, approvals, and exports before relying on them for payroll, discipline, compliance, or other decisions; and
- maintaining any records or backups required by your policies or applicable law.
5. Acceptable use
You may not use HumbleHours to violate law or another person’s rights. You also may not:
- access another workspace, account, or data without authorization;
- misrepresent identity, location, attendance, hours worked, or authorization;
- probe, bypass, disable, or interfere with security, authentication, rate limits, geofencing, audit controls, or service operation;
- upload malicious code, automate abusive requests, scrape the service, or impose an unreasonable load;
- reverse engineer or attempt to extract source code except where that restriction is prohibited by law; or
- use the service to unlawfully monitor, discriminate against, harass, or harm workers or others.
6. Workspace data and privacy
You retain your rights in data submitted to or generated through your workspace (“Workspace Data”). You authorize HumbleHours to host, process, transmit, and display Workspace Data as necessary to operate, secure, maintain, and support the service and as otherwise described in the Privacy Policy.
You represent that you have all rights and permissions needed to provide Workspace Data and instruct HumbleHours to process it. Workspace administrators may access and manage employee account, schedule, attendance, location, device, and audit information according to their permissions.
Device biometric systems are used only where supported. HumbleHours does not receive or store raw fingerprint or facial templates; authentication is performed by the device operating system, while HumbleHours manages revocable sign-in credentials.
7. Time records, location, and reports
Location accuracy can vary because of device settings, signal conditions, permissions, and operating-system behavior. Time calculations and reports depend on the information and rules configured by you. Automatic breaks, clock-outs, overtime indicators, and schedule comparisons are administrative aids and may not match every legal or contractual requirement.
HumbleHours is not a payroll processor, legal adviser, tax adviser, or human-resources adviser. The service does not guarantee compliance with any law, collective agreement, or workplace policy. Review and, where appropriate, correct records before using them for payroll or employment decisions.
8. Mobile applications and kiosks
You are responsible for devices used to access HumbleHours, including their security, operating-system updates, network connection, app-store terms, and location settings. Workspace administrators are responsible for pairing, naming, monitoring, revoking, and physically securing kiosk devices. Do not sideload or distribute an application build in violation of applicable law or third-party terms.
9. Third-party services
HumbleHours may rely on third-party services for infrastructure, maps, email delivery, anti-abuse verification, mobile platforms, and other functions. Those services may be governed by separate terms and privacy practices. HumbleHours is not responsible for third-party services outside its control.
10. Availability and changes
We work to keep HumbleHours available and reliable, but uninterrupted or error-free operation is not guaranteed. Maintenance, security incidents, internet failures, third-party outages, device limitations, or events beyond reasonable control may affect service. Features may be added, modified, limited, or discontinued to improve the service, address security or legal requirements, or respond to technical constraints.
11. Suspension and termination
You may stop using the service at any time. Workspace administrators may deactivate or remove users according to available controls. HumbleHours may restrict or suspend access when reasonably necessary to prevent harm, secure the service, comply with law, address nonpayment under any applicable order, or respond to a material violation of these Terms.
On termination, access to Workspace Data may end. You should export records you are required to keep before closing a workspace. Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and responsibility for prior use—will survive.
12. Ownership and feedback
HumbleHours and its licensors retain all rights in the service, software, designs, trademarks, and related materials, excluding Workspace Data. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable right to use the service for your internal business purposes.
If you provide ideas or feedback, you allow HumbleHours to use them without restriction or compensation, while you retain ownership of any rights you may have in that feedback.
13. Disclaimers
To the maximum extent permitted by law, HumbleHours is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that records, reports, maps, notifications, or calculations will always be accurate, complete, timely, or suitable for your legal and business obligations.
14. Limitation of liability
To the maximum extent permitted by law, HumbleHours and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business interruption arising from the service.
Where liability cannot be excluded, total liability arising out of or relating to the service will not exceed the amount you paid specifically for HumbleHours during the 12 months before the event giving rise to the claim, or US $100 if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnity
To the extent permitted by law, you will defend and indemnify HumbleHours and its operators from third-party claims, damages, and reasonable costs arising from your Workspace Data, your organization’s use of the service, your violation of these Terms, or your violation of another person’s rights or applicable law.
16. General terms
These Terms and the Privacy Policy are the entire agreement concerning your use of the service unless a separate written agreement applies. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without prior written consent; HumbleHours may assign them as part of a merger, reorganization, sale, or transfer of the service. Applicable law and any separately agreed ordering document will determine governing law and venue.
17. Changes to these Terms
We may update these Terms as the service or legal requirements change. The effective date above will be updated when changes are posted. If a change materially affects your rights, we will provide additional notice where reasonably practicable. Continued use after updated Terms take effect means you accept them.
